Hi All,
Quick question...we applied for NSC on aug 2nd..did not hear anything yet. Just wondering did all of u , whose cases got transfered to other centers get Transfer notices or directly receipt notices.
I am gettign tensed as the days are passing by.

Question for the organizers: If we just concentrate on the visa recapture bill, is that not a one shot solution for all issues. Because as per a very respected lawyer, that will make all EB categories current and will stay there for at least 2 more years.

My H1b Extention got approved from Vermont center yesterday.
First 3 year extention filled on July 10th 2008 .
Approval notice sent Email : Aug 27th 2008.
GC Details : PD Jan 2008
I 140 Appoval date : July 31st 2008.
No RFE in h1b extention. One more exp at NJ DMV..
My NJ DL was expiring in Sep 2008 . My visa was expiring in Nov 2008. ( Stamp and I 797 ).

it was smooth process and took 1 hour to get it renew.

Hi...
All mine and my spouse's applications were transfered to Vermont. my I-140 was approved from TSC. My checks were cashed on July17th and that is how I know that it is pending at VSC.
Yesterday I got an email that Card production ordered for EAD. All applications applied on July 6th. I am not sure on what basis they transfered. But it looks like Vermont has started approving the EAD cards. Hopefully, I will get it soon too in the mail.

Let's NOT be hypocrites. We are just venting out our frustrations of these never ending Visa Bulletin life...
We all know that we respect each other and value much more than these occasional emotional outbursts. Donors or Non Donors, USCIS treats us as same shit.
My take would be, if people want to Donate or find that their Donation could help their cause, they will Donate. We can only request people to Donate and put forth our 'Selling points', which I think Pappu, Ameya and others are doing it already.
Please don't stoop down to the level of hating each other on the basis of 'Donor' Vs 'Non-Donor'.
I honestly, think IV should rename that to 'Paid member' or 'Privileged' or 'Subscriber', IMHO, it's NO DONATION. People Donate because they expect something in return...we all want other to donate so that we can have bigger impact, but this is definitely NOT the way to go about it.
Hope it makes sense.

Normally the employer will thread like this. But they wont do anything because if they sue you, they have to spend lot of money then what you have to pay them. Just reply like this.
1. I am ready to face the law suit, I got my attorny and ready to take legal action and I know how to deal with you.
2. I give you this many XX days. Pay me or I am going to refer this case to DOL and DHS.
3. Definitely they will not do anything. Once you refer them to DOL and DHS they are screwed. DHS security will investigate this and if there is any violation of law, this employer can not do any H1 for any one and all their GC process would be in limbo.
Simply they can not afford to take legal action or face DHS. If I were you I would do whatever it takes to recover my money. I wont let them go without hard time.
Be bold and do this.

hope that means they are willing to talk about giving EAD. If we get EAD all the lawsuits will be withdrawn. The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. should we add the following content?
EB quota is only a small share compared to overall immigration quota. Per Country cap on family based immigration can still be remained to ensure diversity. However, we request to remove country cap on EB immigration. US employees are only looking for talents to keep competitiveness, no matter the talents is from India, China, or Luxembourg .
Below is what I sent. Maybe we can tweak this letter and send it to all senators and congressmen.

I wanted to bring to your attention the plight of hundreds of thousands of highly skilled Indian immigrants waiting endlessly for many years in order to obtain a permanent residency in the US. The process of getting a permanent residency is a long, winding, time consuming, financially and emotionally draining experience, with no end at sight. After 5 to 10 years of waiting in line, paying taxes, obeying law, many high skilled workers from India find that permanent residency is only a dangling carrot that they may never get it.
One of the biggest hurdles for high skilled immigrants from India is a country cap that limits applicants from any one country from having more than 7% of the available employment based green cards (140,000 visa numbers per year). This means applicants from countries like Andorra and Luxembourg get the same number of green cards as applicants from India and China. (I had posted a similar note a couple of weeks ago. I apologize for doing so again, but I feel this needs to be said).
We legal immigrants need to make our voices heard because 99% of the US Citizens do not know our (sad) story. Here are some highlights (nothing new to the users of this site):
1. Most of us are highly educated.
2. .. work hard (because otherwise why would our employers sponsor us).
3. .. follow all the laws and pursue legal immigration.
4. .. are deeply invested in this country - so many of us own houses, mutual funds, etc. that are investments in the Economy.
5. .. contribute to the society in a variety of ways including: paying taxes, inventing so much of the new technologies (especially in the computer industry).
It wouldn't be too hard to get statistics on how much employment-based immigrants contribute to the economy - number of companies started by former immigrations, number of patents filed, US citizens employed by such companies, correlation of the growth of the Computer Industry with Employment based Immigration. I believe a very strong case can be made in our favor.
And all we ask for is a fair shot at permanent residence in this country. Not only do we not get that, the process is opaque and we have NO idea how long it may take for us to navigate each one of the many stages of this process. The process is completely unbounded and we have no way to planning our lives.
I bet if the US Citizens at large find out what we go through day-to-day they would be appalled. One way to do so is to peacefully protest in public - perhaps outside the USCIS offices. It is probably a dumb idea, but I wanted to bring it up - let us not sell our selves short, there are a lot of us and if we combine our voices it would be loud enough to get to the right ears. I am sure we will see action.

It is indeed sad that you continue to pontificate from a perch of indifference and ignorance. We all know that the entire EB immigration system is not a zero sum game (just ask Ron Hira and his ilk). Sad thing is, when it comes to EB3 I's, EB 2's such as you suddenly transform into a Ron Hira lite ... going about throwing broad hints about how the system is setup the way it is ... to serve those 'higher in the pecking order'.
If we were to buy this weak attempt at making a 'logical point', I would be glad to give Ron a call and have his folks look into YOUR respective EB2 applications and find out if there REALLY was "NO" qualified US worker available for that job. Want to play that game?
Look, the EB system is what it is. Instead of trying to bait others into silence by suddenly finding 'fairness in this system', only because this part of the puzzle narrowly goes to serve / protect your gains ... try to come together to fix the underlying weakness in the system.
For the record, I am not bitter about a 7+ year 'wait'. On the contrary, I have grown professionally thanks to the opportunity to focus my energies towards building a Billion dollar corporation. That said, I would LOVE to see the paperwork of EB2 Java 'gurus' and L1 converts stand up to true scrutiny ... and that would open a whole new can of worms. Game?
I know only of Java coffee:). I promise you Ron Hira wouldn't be interested in my application.
It looks like EB2-EB3 having overlapping qualifications is a major source of frustration for you. I have similar issues with EB1-EB2 overlaping qualifications.
